1. Introduction

These Terms and Conditions (“Terms”) govern your access to and use of the eMBArk website (the “Website”), mobile applications (the “Apps”), and any related services offered by eMBArk (collectively, the “Platform”). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree to all of the Terms, you are not authorized to use the Platform.

2. Eligibility

You must be at least 18 years old to use the Platform. If you are between 13 and 18 years old, you may only use the Platform with the permission of your parent or legal guardian.

3. Registration

To access certain features of the Platform, you may be required to register for an account. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. You agree to notify eMBArk immediately of any unauthorized use of your account or any other security breach.

4. Content and Intellectual Property

The Platform contains content, including course materials, text, graphics, videos, and other materials (collectively, the “Content”). The Content is protected by copyright, trademark, and other intellectual property laws. You may not use the Content for any commercial purpose without the express written permission of eMBArk.

5. Use of the Platform

You agree to use the Platform only for lawful purposes and in accordance with these Terms. You agree not to use the Platform:

• In a way that violates any applicable law or regulation.
• To harm, threaten, abuse, or harass others.
• To impersonate any person or entity.
• To interfere with the operation of the Platform.
• To transmit any viruses or other harmful code.
• To create a false or misleading impression about yourself or your affiliation with eMBArk.

6. Fees and Payments

You may be required to pay a fee to access certain features of the Platform. The fees will be clearly displayed before you are required to make a payment. eMBArk uses a third-party payment processor to handle all transactions. You are responsible for reading the terms and conditions of the payment processor before making a payment. Please refer to our Refund Policy for information on refunds.

7. Disclaimer
The platform is provided to you “as is” and “as available” and with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, Embark, on its own behalf and on behalf of its affiliates and its and their respective licensors and service providers, expressly disclaims all warranties, whether express, implied, statutory or otherwise, with respect to the platform, including all implied warranties of merchantability, fitness for a particular purpose, title and non-infringement, and warranties that may arise out of course of dealing, course of performance, usage or trade practice. Without limitation to the foregoing, Embark provides no warranty or undertaking, and makes no representation of any kind that the platform or the services or products offered therein will meet your requirements, achieve any intended results, be compatible or work with any other software, applications, systems or services, operate without interruption, meet any performance or reliability standards or be error free or that any errors or defects can or will be corrected.

8. Limitation of Liability
In no event shall Embark be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the platform, even if Embark or any authorized representative of Embark has been notified orally or in writing of the possibility of such damage.

9. Indemnification

You agree to indemnify and hold harmless eMBArk and its officers, directors, employees, agents, and licensors from and against any and all claims, demands, losses, liabilities, costs, or expenses (including attorney’s fees) arising out of or related to your use of the Platform.

10. Links to Third-Party Websites

The Platform may contain links to third-party websites. eMBArk is not responsible for the content or privacy practices of these websites. You should review the terms and conditions of any website you visit from the Platform.

11. Governing Law and Jurisdiction

These Terms will be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located in Chennai, India.

Entire Agreement and Severability

These Terms constitute the entire agreement between you and eMBArk with respect to your use of the Platform. If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.
